1. Acceptance of Terms

By downloading, installing, and using Momentum on your device, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use this application.

2. Use License

Permission is granted to download and use Momentum for personal, non-commercial use only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify, copy, or create derivative works of the application
• Use the application for any commercial purpose without written permission
• Attempt to decompile, reverse engineer, or disassemble the software
• Remove any copyright or other proprietary notations from the application
• Use the application to collect or harvest data about other users
• Distribute or resell access to the application or its features

3. User-Generated Content

You retain all rights to the habit data, goals, and personal information you enter into Momentum. By using our service, you grant us a limited license to process your data to provide AI-powered habit suggestions and check-ins. Your personal data will not be used to train AI models or shared with third parties for marketing purposes.

4. AI-Powered Features

When you use AI features in Momentum (habit generation, AI check-in), you represent and warrant that:

• The goals and information you provide are accurate and for personal use
• You will not attempt to misuse or manipulate the AI system
• You understand that AI suggestions are not a substitute for professional medical, psychological, or health advice

5. AI Technology and Processing

Momentum uses advanced AI technology to generate personalized habit suggestions and provide check-in analysis. While we strive for high-quality results, we cannot guarantee that:

• AI-generated habit suggestions will be perfectly suited to your goals
• The service will be error-free or uninterrupted
• AI analysis will meet all user expectations

6. Prohibited Content

You agree not to use Momentum to:

• Input content that is illegal, hateful, violent, or harmful
• Attempt to extract, scrape, or misuse AI-generated content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights

7. Subscription and Pro Features

Momentum offers optional Pro subscription plans (monthly, yearly, and lifetime) that unlock additional features including unlimited AI habit generation, unlimited AI check-ins, and detailed statistics. Subscriptions are managed through Apple's App Store and are subject to Apple's terms of service. Refunds are handled according to Apple's refund policy.

8. Disclaimer

The application is provided on an 'as is' basis. Definitely Human makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

9. Limitation of Liability

In no event shall Definitely Human or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the application, even if Definitely Human or an authorized representative has been notified orally or in writing of the possibility of such damage.

10. Third-Party Services

Momentum utilizes third-party AI services for habit generation and check-in analysis, as well as Firebase for data management. By using Momentum, you agree to the terms of service of these third-party providers. Definitely Human is not responsible for their practices or policies.

11. Termination

Definitely Human reserves the right to suspend or terminate your access to Momentum at any time, without notice or cause, if we determine that you are violating these terms or applicable laws.

12. Changes to These Terms

Definitely Human may revise these terms of use at any time without notice. By continuing to use Momentum, you are agreeing to be bound by the then current version of these terms of use.
