1. Acceptance of Terms

By downloading, installing, and using Avatar Studio on your device, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use this application.

2. Use License

Permission is granted to download and use Avatar Studio for personal, non-commercial use only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify, copy, or create derivative works of the application
• Use the application for any commercial purpose without written permission
• Attempt to decompile, reverse engineer, or disassemble the software
• Remove any copyright or other proprietary notations from the application
• Use the generated avatars for illegal purposes or to impersonate others
• Distribute generated avatars in a manner that violates third-party rights

3. User-Generated Content and Avatar Ownership

You retain all rights to the photos and images you upload to Avatar Studio. However, by using our service, you grant us a limited license to process your images and generate avatars for your personal use. Generated avatars can be used, shared, and distributed by you as you see fit, provided such use complies with applicable laws and does not violate third-party rights.

4. Photo Upload and Privacy

When you upload photos to Avatar Studio, you represent and warrant that:

• You own or have permission to use the images you upload
• You have obtained any necessary consents from individuals featured in the photos
• The uploaded images do not contain content that is illegal, offensive, or violates third-party rights

5. AI Technology and Processing

Avatar Studio uses advanced AI technology to generate avatars. While we strive for high-quality results, we cannot guarantee that:

• Generated avatars will perfectly represent the uploaded photo
• The service will be error-free or uninterrupted
• Generated avatars will meet all user expectations

6. Prohibited Content

You agree not to use Avatar Studio to:

• Create avatars intended to deceive, defraud, or impersonate others
• Generate content that is illegal, hateful, violent, or sexually explicit
• Violate any applicable laws or regulations
• Infringe on intellectual property rights

7. Disclaimer

The application is provided on an 'as is' basis. Definitely Human makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

8. Limitation of Liability

In no event shall Definitely Human or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the application, even if Definitely Human or an authorized representative has been notified orally or in writing of the possibility of such damage.

9. Third-Party Services

Avatar Studio utilizes third-party AI models and services (including Replicate AI and Firebase) for image processing and data management. By using Avatar Studio, you agree to the terms of service of these third-party providers. Definitely Human is not responsible for their practices or policies.

10. Termination

Definitely Human reserves the right to suspend or terminate your access to Avatar Studio at any time, without notice or cause, if we determine that you are violating these terms or applicable laws.

11. Changes to These Terms

Definitely Human may revise these terms of use at any time without notice. By continuing to use Avatar Studio, you are agreeing to be bound by the then current version of these terms of use.
